1. Acceptance of Terms
By accessing or using any services provided by TableEyes LLC (“TableEyes,” “we,” “us,” or “our”), including our website at tableeyes.com, customer portal at portal.tableeyes.com, digital kiosk platform, and SMS/voice communication services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our services.
2. Description of Services
TableEyes provides a digital kiosk platform for hospitality venues including restaurants, bars, hotels, and casinos. Our services include digital kiosk hardware, content management through our customer portal, AI-assisted content scheduling, SMS and voice communication services for kiosk management, and advertising display services.
3. Account Registration
To use our platform, you must create an account and provide accurate, complete information including your name, email address, phone number, and business details. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

By providing your mobile phone number during account registration and agreeing to these Terms, you expressly consent to receive SMS and voice communications from TableEyes. These communications include:
- Scheduling confirmations and status updates
- Account and service notifications
- AI-assisted kiosk management responses
- Customer support communications
Message frequency varies based on your interaction with the service.
Message and data rates may apply. Check with your mobile carrier for details.
To opt out: Reply STOP to any SMS message from TableEyes. You will receive a confirmation message and no further messages will be sent unless you re-subscribe.

Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, Sprint, and all major US carriers. TableEyes is not responsible for delayed or undelivered messages due to carrier network issues.
5. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Upload content that infringes on intellectual property rights of others
- Upload content that is obscene, defamatory, or harmful
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Use our platform to send spam or unsolicited communications to kiosk end users
- Reverse engineer, decompile, or disassemble any part of our platform
- Resell or redistribute our services without written authorization
6. Content Ownership and License
You retain ownership of all content you upload to the TableEyes platform. By uploading content, you grant TableEyes a non-exclusive, worldwide license to display, transmit, and cache your content solely for the purpose of operating the kiosk platform and delivering your content to your designated kiosks.
TableEyes retains ownership of all platform software, TEHQ-prefixed corporate content, and proprietary technology.
7. Advertising
TableEyes reserves a portion of kiosk screen airtime for displaying advertising content managed by TableEyes. This advertising may include local, regional, and national advertisements. Venue operators acknowledge this advertising component as part of the TableEyes service.
8. Service Availability
We strive to maintain high availability of our platform but do not guarantee uninterrupted service. We are not liable for any downtime, delays, or interruptions due to maintenance, updates, internet outages, power failures, or circumstances beyond our control.
9. Payment Terms
Subscription fees, if applicable, are billed monthly. Payment terms will be specified in your individual service agreement. TableEyes reserves the right to suspend service for accounts with outstanding payments.
10. Privacy
Your use of our services is also governed by our Privacy Policy, available at tableeyes.com/privacy-policy. By using our services, you consent to the collection and use of information as described in the Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, TableEyes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of or inability to use our services.
Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid to TableEyes in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless TableEyes, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your content, or your violation of these Terms.
13. Termination
Either party may terminate the service relationship with thirty (30) days written notice. TableEyes may immediately suspend or terminate your account if you violate these Terms. Upon termination, your content will be removed from all kiosks and our platform within a reasonable timeframe.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the customer portal. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts of Cook County, Illinois.
